My company did a job a few weeks back, and the customer refused to pay. We cleaned the lobby of a small hotel,moved sofas and everything,took a whole sh*t load of dirt and mud out, and the owner of the hotel told me he didn't like the job, i left the invoice with the girl at the front desk, and when i called him he told me he's not making out the check...i told him he needed to pay, he never did,,,,
How can i collect payment by law??????

There's nothing you can do but take him to small claims court. I think you should also have them sign a wavier before you start the job.......not so much home owners but big companies that feel they can pull this kind of sh*t and get away with it. The guy probably does it twice a year to different companies.

i should have never started the job, now that i remeber when i was talking to him about the price, he told me"some guys offer to do it free, and if i like it i give them alot of work because i own three hotels" i told him we don't do it for free, then he wanted it for really cheap, i should have just walk away........................

It was a two part lobby,two sides i'll just say the job was done in two parts, well if he won't pay i'm going to have to srew him over

Mike sometimes it is a hassle and a time commitment on your part that may not make it worth while. Sometimes you have to let it go and learn to listen to your instincts.

invoice him in two parts, one invoice for each side of the lobby, to make the price higher,send him a second invoice in the mail, so i can pay the collection fees

true, i should let it go, but i can't, its the point and the way this guy talked to me on the phone, he was really rude and has no intent to pay, for are time and labour............

Twice in my career. Got half in the pre-trial both times. Last one was 6 years ago. Most of my rip-offs in the last 6 years have been bounced checks under $100. I usually send them collection threatening letters until they pay.

cmss...was the motel guy named Patel?...I quit dealing with motels years ago...because of the Patels...they are the worst people to deal with...they will do anything to keep from paying...as for collecting from them, you can take them to small claims court...that's about all you can do...if you get the court to go your way, they will allow you to collect the invoice price plus your expenses in filing...have you ever cleaned anything at that motel before?...if so, then you will ahve a valad case, if he claims you didn't do the job right...I once had one who refused to pay on 4 invoices...claimed that I didn't clean the carpets very good...the judge asked him if I wasn't doing such a good job, then why did he keep using me...I won the case...but it was such a hassel to go through...that's why I don't fool with motels any more...they are just a waist of my time...

hey, MR Steamer...how about going and cleaning a really nasty resturant and then going back to the motel and hooking up a couple of sections of vac hose to the dump and dumping right in the middle of the lobby...that's what I thought about doing to one of those Patels (the one I took to court)...but my better half talked me out of it...LOL

If he told me he wasn't happy with the job I would have redone it and chances are with the amount of dirt and mud you are describing

then if he refused to pay I would dump my waste tank in the lobby after a cat urine job

Payment due upon receipt on your invoice..mention that to all custys. and make sure they sign the invoice... I never had a problem yet... You have to take control once your foot is in the door...
If they say "well we pay in 30-90 days.. i walk away... or if your on the phone..I will get back to you.. get PAID when your done or don't do the job... after 20yrs of hearing all the excuses i don't roll-the-dice anymore with them.... been ripped off once by a res. custy.. check bounce and she moved out... I didn't know she was moving... the bank told me she's been bouncing checks all week.....
Less accounts receivables to worrrrryyy!! about....

In a perfect world we'd all get paid at the end of every job. Unfortunately this world is far from perfect.
Most customers who want you to continue doing work for them will pay you within 30 days. If they don't, the next time they call, you tell them you want payment up front or immediately after the job is done.

see this is where all you guys go wrong...
Don't give anyone credit right off the bat.... if they want credit they have to fill out a credit app.... with 3 references of other buisness contacts and banking info... so you can check it..
and no credit should be extended on the first order..
once they hear credit app most companies will cut you a check right away

I get a credit card number for every job unless I have a credit ap or unless they are government or a bank.
I don't process the credit card till after 30 days but even companies mail a cheque fast when one of their employees has had to give a personal card number to book. This way you have someone on the inside harassing accounting or the owner to get a cheque out.

I don't extend credit to anyone any more...especially a motel or resturant...they always collect as soon as their customers are finished...and that's what I expect from them...

I've only had one commercial customer so far. But I got 50% UP FRONT, and 50% AT JOB END! It was a hotel and they were cool with that.

All these things can happen. And, yes in business you're gonna get write offs. At some point you do have to suck it up and cut your losses.
BUT I have to say that at least getting the card up front tends to eliminate the guys that had no intent to pay in the first place which is what this yahoo sounds like. Guys like this don't even have credit so they have to tell you "I don't have a credit card". This sends me a clear message to get cash up front or don't clean. In the end, all this achieves is another way to TRY to get paid.

Greg that's all well and good............you can not sense a scam all the time..........the best con man..........is the nicest guy you want to meet.
